1.1 Contract

If you use our services, you agree to all of these terms. Your use of our Services is also subject to our Cookie Policy and Privacy Policy, which cover how we collect, use, share, and store your personal information.

You agree that by clicking “Join,” or similar, registering, accessing, or using our services (described below), you agree to be legally bound by a contract with Profesea.id (even if you are using our Services on behalf of a company). If you do not agree to these “Terms & Conditions,” do NOT click “Join Now” (or similar) and do not otherwise access or use any of our Services. If you wish to stop, you may do so at any time by closing your account and no longer accessing or using our Services.

Services

This Contract applies to Profesea.id, Profesea.id-branded applications, Profesea.id Learning, and other Profesea.id-related sites, apps, communications, and services that state they are offered under this Contract (“Services”), including off-site data collection for such Services, such as advertising and the “Apply with Profesea.id” and “Share with Profesea.id” plugins. Registered users of our Services are called “users,” and unregistered users are called “Visitors.”

Profesea

You are entering into this Contract with Profesea.id (also referred to as “we” and “us”).

This Contract applies to Users and Visitors.

As a Visitor or user of our Services, the collection, use, and sharing of your personal data is subject to this Privacy Policy and its updates.

1.2 Users and Visitors

When you register and join Profesea.id's Services, you become a user. If you choose not to register for our Services, you may access certain features as a “Visitor.”

1.3 Changes

We may make changes to the Contract.

We may modify this Contract, our Privacy Policy, and our Cookies Policy from time to time. If we make material changes to this contract, we will provide notice through the Services or by other means to give you an opportunity to review the changes before they take effect. Both parties agree that changes will not be applied retroactively. If you do not agree with these changes, you may close your account. If you continue to use our Services after we publish or send notice of changes to these terms, that means you agree to the updated terms as of their effective date.

2. Obligations

2.1 Service Eligibility

Here are a few of your promises to us under this Contract:

You are eligible to enter into this Contract and are at least our “Minimum Age.”

Profesea.id's Services are not intended for use by anyone under the age of 16.

To use the Services, you agree that: (1) you must be of “Minimum Age” (defined below) or older; (2) you may only have one Profesea.id account, which must be under your real name; and (3) you are not already restricted by Profesea.id from using the Services. Creating an account with false information violates our terms, including accounts registered on behalf of others or of persons under the age of 16.

“Minimum Age” is 16 years old. However, if applicable law requires that you be older for Profesea.id to lawfully provide the Services to you without parental consent (including for the use of your personal data), then the applicable Minimum Age is that older age.

2.2 Your Account

You must keep your password confidential.

You will not share your account with anyone else and will comply with our laws and regulations. Users own their account. You agree to: (1) use a strong password and keep it confidential; (2) not transfer any part of your account (e.g., connections); and (3) follow the law and our Dos and Don'ts list. You are responsible for anything that happens through your account unless you have closed it or reported misuse.

Between you and others (including your employer), your account belongs to you. However, if the Services were purchased by another party for your use (e.g., a Recruiter license purchased by your employer), the party paying for the Services has the right to control access to and receive reports on your usage of that paid Service; however, they do not have rights to your personal account.

2.3 Payment

You will honor your payment obligations, and you agree that we store your payment information. You also understand that additional fees and taxes may be added to the prices we charge.

If you purchase any of our paid Services (“Premium Services”), you agree to pay the applicable fees and taxes to us. Failure to pay these fees may result in the termination of your paid Services. Payment can only be made using the Payment Gateway available on the Profesea.id service.

2.4 Notices and Messages

You agree that we will send notices and messages through the website, apps, and your contact information. If your contact information is not up to date, you may miss important notices.

You agree to receive notices and messages from us using the following methods: (1) within the Services, or (2) sent to the contact information you provided to us (e.g., email, phone number, physical address).

2.5 Sharing

When you share information about our Services, others may view, copy, and use that information.

Our Services allow messaging and sharing of information in various ways, such as your profile, articles, group posts, links to news articles, job postings, messages, and InMail. Information and content you share or post may be viewable by other users, Visitors, or others (including outside the Services). Where we provide settings, we will respect the choices you make about who can see your content or information (e.g., message content to your address, sharing content only with your Profesea.id connections, restricting profile visibility from search engines, or declining to notify others about your Profesea.id profile updates). For job-seeking activity, our default is not to notify your network of connections or the public. So, if you apply for a job through our Services or choose to signal your interest in a job, by default Profesea.id only shares this with the poster of that job listing. We are not obligated to publish any information or content on our Services and may remove it with or without notice.

3. Rights and Limitations

3.1 Your License to Profesea.id

You own all the content, input, and personal information you provide to us, but you also grant us a non-exclusive license to that material. We will respect the choices you make about who can see your information and content, including how it is used for advertising.

Between you and Profesea.id, you own the content and information you submit or post on the Services, and you grant Profesea.id and our affiliates only the following non-exclusive license:

A worldwide, transferable, and sublicensable right to use, copy, modify, distribute, publish, and process the information and content you provide through our Services or those of others, without further consent, notice, and/or compensation to you or others. These rights are limited as follows:

• You may terminate the license for specific content by removing it from the Services, or generally by closing your account, except (a) to the extent you shared it with others as part of the Services and they copied, re-shared, or stored it, and (b) for the reasonable period needed to remove it from backups and systems.
• We will not include your content in advertisements for third-party products and services to others without your separate consent (including sponsored content). However, we reserve the right to display ads near your content and information, without payment to you or others, and your social actions may be visible and included with ads, as stated in the Privacy Policy. If you use a Service feature, we may mention your name or photo to promote that feature within our Services, depending on your settings.
• We will seek your consent if we want to give others the right to publish your Content beyond the Services. However, if you decide to share your posts as “public, everyone, or similar,” we will enable features allowing other users to embed that public post in third-party services, and we allow search engines to make that public content discoverable through their services.
• While we may edit and change the format of your content (such as translating or transcribing it, resizing, changing layout or file type, or removing metadata), we will not change the meaning of your expression.
• Because you own your content and information and we only hold a non-exclusive right to it, you may choose to display it to others.

You and Profesea.id agree that if content contains personal data, that content is subject to our Privacy Policy.

You and Profesea.id agree that we may access, store, process, and use any information and personal data you provide, in accordance with the terms of the Privacy Policy and your choices (including your settings).

By submitting suggestions or other feedback about our Services to Profesea.id, you agree that Profesea.id may use and share (but need not) that feedback for any purpose without compensation to you.

You promise to provide only information and content that you own or are authorized to share, and that your Profesea.id profile is truthful.

You agree to provide only content or information that does not violate the law or anyone's rights (including intellectual property rights). You also agree that you will provide truthful information in your profile. In certain countries, Profesea.id is legally required to remove certain information or content.

3.2 Service Availability

We may change or discontinue the Services or change prices in the future.

We may modify, suspend, or discontinue our Services. We may also change the prices of our services in the future by providing reasonable prior notice as permitted by law.

We do not promise to store or continue displaying any information or content you post. Profesea.id is not a storage service. You agree that we have no obligation to store, maintain, or provide a copy of any content or information provided by you or others, except to the extent required by applicable law and as stated in our Privacy Policy.

3.3 Other Content, Sites, and Applications

Your use of content and information belonging to others that is posted on our Services is at your own risk.

Other parties may offer their products and services through our Services, and we are not responsible for the activities of such third parties.

By using the Services, you may encounter content or information that may be inaccurate, incomplete, delayed, misleading, illegal, offensive, or otherwise harmful. In general, Profesea.id does not review content provided by our users or other parties. You agree that we are not responsible for content and information belonging to other parties (including other users). We cannot always prevent misuse of our Services, and you agree that we are not liable for such misuse. You also acknowledge the risk that you or your organization may be mistakenly associated with content about other parties when we notify connections and followers that your name or organization is mentioned in the news.

Profesea.id may help connect Users who offer services; Profesea.id does not operate or employ individuals to perform these services. You must be at least 18 years old to offer, perform, or obtain these services. You acknowledge that Profesea.id does not supervise, direct, control, or monitor users when operating these

services, and you agree that (1) Profesea.id is not responsible for the offering, performance, or procurement of these services, (2) Profesea.id does not endorse any particular user offering services, and (3) such services do not create any employment, agency, or joint venture relationship between Profesea.id and any user offering services. If you are a user offering services, you represent and warrant that you hold all licenses required.

3.4 Limitations

We reserve the right to limit how you connect and interact on our Services.

Profesea.id reserves the right to limit your use of the Services. Profesea.id reserves the right to restrict, suspend, or terminate your account if you violate this Contract or the law, or misuse the Services.

3.5 Intellectual Property Rights

We provide you notice regarding our intellectual property rights.

Profesea.id owns all intellectual property rights in the Services. Other trademarks and logos used in connection with the Services are the trademarks of their respective owners. Profesea.id, the “in” logo, and other Profesea.id trademarks, graphics, and logos used for our Services are trademarks or registered trademarks of Profesea.id.

4. Profesea.id's “Dos and Don'ts”

Profesea.id is a professional community. This “Dos and Don'ts” list limits what you can and cannot do on our Services.

4.1 Dos

You agree that you will:

• Comply with all applicable laws, including but not limited to privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements;
• Provide accurate information to us and keep it updated;
• Use your real name on your Profile; and
• Use the Services in a professional manner.

4.2 Don'ts

You agree that you will not:

• Create a false identity on Profesea.id, create a user profile for anyone other than yourself (a real person), or use or attempt to use another's account;
• Develop, support, or use software, devices, scripts, robots, or any other means or processes (including crawlers, browser plugins and add-ons, or other technology) to scrape data from the Services or otherwise copy profiles and other data from the Services;
• Override any security feature or bypass or circumvent any access controls or usage limits of the Service (such as caps on keyword searches or profile views);
• Copy, use, disclose, or distribute any information obtained from the Services, whether directly or through third parties (such as search engines), without the consent of Profesea.id;
• Disclose information that you do not have the right to disclose (such as confidential information about others, including your employer);
• Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights. For example, do not copy or distribute (except through available sharing functionality) postings or content belonging to others without their permission, which they may give by posting it;
• Violate Profesea.id's intellectual property or other rights, including but not limited to, (i) copying or distributing our learning videos or other materials, or (ii) copying or distributing our technology, unless it is released under open source license; (iii) using the word “Profesea.id” or our logos on business cards, emails, or URLs;
• Post anything that contains software viruses, worms, or other harmful code;
• Reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code for the Services or any related technology that is not open source;
• Imply or state that you are affiliated with or endorsed by Profesea.id without official consent (e.g., representing yourself as a trainer accredited by Profesea.id);
• Rent, lease, lend, sell/resell or otherwise monetize the Services or related data or access, without Profesea.id's consent;
• Deep-link into our Services for any purpose other than promoting your profile or a Group on our Services without Profesea.id's consent;
• Use bots or other automated methods to access the Services, add or download contacts, or send or redirect messages;
• Monitor the Services' availability, performance, or functionality for any competitive purpose;
• Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;
• Alter or modify the Services or their appearance (e.g., by inserting elements into the Services or moving, removing, or hiding advertisements included in the Services);
• Interfere with the operation of, or place an unreasonable burden on, the Services (e.g., spam, denial of service attacks, viruses, gaming algorithms).

5. Complaints Regarding Content

Contact information for complaints about content provided by our users.

We respect the intellectual property rights of others. We require that information posted by users be accurate and not infringe the intellectual property or other rights of third parties. We provide policies and processes for complaints regarding content posted by our users.
